Twist Added To The Whittemore Story

Following up on the Whittemore story:

UNR's major donor, Harvey Whittemore, responded to his former business partners, who sued him last week, by filing one of his own, claiming his partners were guilty of racketeering, extortion, and fraud.

A copy of the court filing can be found here.

One thing that appears to be agreed upon between the adverse parties is that Whittemore owed his former partners a lot of money.

According to the former partners, Whittemore owed them money because Whittemore and his wife had embezzled millions from them.

According to Whittemore, the money he owed his partners was legally obtained debt.

We cannot help but ponder a few things in following this story:

1) It is clear that corrupt Reno attorney Kent Robison has a personal vendetta against Whittemore. A review of public records reveals that this is not the first time Robison has gone after Whittemore.

2) Robison likes to see his name in the paper. Insecure people do.

Notice how none of the attorneys are talking to the media on either side . . . except Robison. If you read the initial court filing, Robison is not even the main attorney for the partners. He did not write or file the court papers.

3) Martha Bellisle, the RGJ reporter on this story is Robison's media puppet.

Notice that Bellisle broke the original story on this, not the media in Las Vegas, where the initial case was filed. Robison pushed the story to Bellisle to attack Whittemore in the press and get his own name in the paper.

When Robison wants to smear someone in the media through the use of court files (to hide behind defamation liability) he uses Bellisle. Bellisle repeatedly lies to the community in stories on behalf of Robison.

4) Leif Reid appears to be silent in this matter. Reid has been Whittemore's long-time personal attorney. Yet he is not representing Whittemore here.

5) Will Chancellor Daniel Klaich and Athletic Director Cary Groth return the Whittemore's donations if the money UNR received was illegally obtained through embezzlement?

Unwinding A Tangled Web Of Corruption

Here is the latest report on the embezzlement allegations leveled against UNR's top donors, Harvey and Annette Whittemore.

According to this story, at least two agencies are investigating allegations against developer and lobbyist Harvey Whittemore.

The Reno Police Department and the State Bar of Nevada are reviewing the claims filed by Whittemore's former business partners, who are accusing him of embezzling and misappropriating more than $40 million.

Whittemore, known to be a longtime friend of Sen. Harry Reid and family, was once considered the most powerful legislative lobbyist in Nevada and one of the top gaming attorneys in the United States.

Ironic that we have the goods for Mr. Whittemore to turn the tables on one of the lawyers representing Whittemore's former partners in this matter.

The lawyer is, of course, the oh-so-corrupt Kent Robison.

One would expect that the plaintiff's will drop Robison from their legal team when they find out that Robison himself is under criminal investigation for, among other things, fraud and embezzlement!

We are curious to see if Leif Reid will represent Whittemore in this matter. Leif Reid has also been known to represent Cindy Fox.

UNR's Retaliation Apparatus To Silence Whistleblower's

We've seen examples of faculty, staff, coaches, police officers, and citizens who have evidence of criminal violations, and they've suffered massive retaliation at the hands of the whole University of Nevada, Reno retaliation apparatus that protects the upper-level administrators.

The retaliation apparatus involves the President's private police force, the UNRPD. It also involves the human resources and affirmative action offices.

Affirmative action is designed to protect the faculty, staff and students. But at UNR it's turned around and used as a tool for harassment by conducting secret investigations of whistleblowers.

You've seen evidence that the president's office and the attorneys working for the president's office have actually intimidated the local media to make sure that they're really just a mouthpiece for the university administration and won't print most of the allegations that come forth from whistleblowers.

Other parts of the protection and retaliation apparatus are the general counsel's office (led by Mary Dugan). And that office is housed within the president's office. Therefore, everything that they do has the explicit recognition and approval of the upper administration.

What is all this trying to protect?

It's trying to protect widespread abuses of the law involving financial crimes, athletic department crimes, police department crimes, EEO crimes, legal counsel crimes, and the whole UNR abuse of power.

UNR's message to faculty, staff, students and the public: If you challenge our power, we will threaten, intimidate, harass, demote, dismiss, sue and sanction you, and we'll get the taxpayers to pay for it.

I'm sure that when you first heard us say this or first read our documents you thought this was a pretty outrageous claim: UNR as a RICO operation. We submit to you that we have described and presented evidence that meets all 11 elements of the FBI RICO criteria.

You do not have to be a fan of soccer to appreciate this article on Spains victory in the World Cup:

Spain's victory lifted my heart because it was done the right way.

In the final against Holland, in the face of the most appalling provocation, Spain stuck to playing soccer the way it was meant to be played and triumphed. It is not easy for highly trained athletes to do this.

In Sunday's final, Gabi Alonso nearly had his sternum crushed by a karate kick by Nigel De Jong that if it had been three inches higher probably would have snapped his neck. Andres Iniesta was subjected to the kind of leg whipping and direct assault on his knees that has long been banned in the NFL.

It would have been understandable if one of the Spanish players tried to break Arjen Robben's leg.

Understandable but wrong.

In any case, Spain kept their cool and courage and stuck to their uncynical game plan focused on playing the ball forward and looking to score.

Holland took the short term, do whatever it takes even if you break the rules approach beloved of shadow bankers and short-sellers everywhere.   Spain won.

Here's the metaphor: In a time when rule breakers have all the advantages; when people who are already phenomenally rich game the law in much the same way as the Dutch gamed the referee — what was he going to do? Show a couple of red cards in the final?

When people who try to do things the right way find themselves thrown out of work by short-term thinking managers, small businesses are unable to get finance because banks are oriented towards generating money for their bonuses.

In short when we stand on the precipice of economic catastrophe because people get no reward for living the right way, Spain's victory shines out.

Be courageous, play your game, shrug off the cheap shots, eyes on the prize and you can win.

Nevada A.D. Cary Groth "Knows Her Career Is Sunk"

What this says to me, and it is gooseflesh raising, is that Cary Groth thinks that her actions are STILL "invisible," and no one is really watching her; she can still do as she wishes, and even if someone finds out, the interim president and the regents will protect her.

Or, she knows her career is sunk, anyway, so she continues to recklessly engage in illegal behavior.

Many at UNR, coaches and administrators, have been engaging in criminal and fraudulent acts for so long, they don't even know right from wrong anymore, and are void of ethics, even when proved unethical.

NCAA rules and regulations have totally seeped and escaped through Groth's eye and ear, right out the other eye and ear! They don't apply to her.

Nothing, it seems, has sunk into her brain.

Keep a low profile? Not Cary Groth. She still thinks she is invisible, and so do many of the rest of the UNR administrators and lawyers!

They must think they can still protect one another and go unpunished and without consequences.

Regent Unimpressed With UNR's Presentation To BOR

Two posts below in "UNR Administration Prepared to Lie to Regents?" we discussed UNR's planned presentation on NCAA compliance at the December 1-2, 2011, Board of Regents meeting.

Unsurprisingly, President Marc Johnson, A.D. Cary Groth, and FAR Jean Perry delivered the powerpoint as planned, even in the face of the stunning information that had been provided to them on November 21, 2011.

More details on that outrageous error later . . .

It turns out that we weren't the only ones disappointed in the three amigos (Johnson, Groth and Perry).

Regent Kevin Page publicly stated that he was "unimpressed" with their presentation. Page also expressed his displeasure over the fact that Nevada is currently on NCAA probation.

Two words for Regent Page: Brace Yourself.

Here are a few other notable comments made at the meeting:

"The President is held accountable for anything that happens within the athletics department" - Vice Chancellor Jane Nichols.

Is Marc Johnson wishing to end his career in higher education by failing to exercise control over the Nevada athletic department and his corrupt A.D.?

"Cary and I have an excellent working relationship. We communicate regularly." - FAR Jean Perry.

This comment begs the following questions: What exactly do Jean and Cary talk about? Does Cary provide Jean with "false and misleading information" or are they partners in crime?

No later than August, it would be a safe bet that the University of Nevada will have a new President, Athletic Director, and Faculty Athletic Representative ...

What Did He Possibly Think He Could Hide From NCAA?

By now it is a done deal, but I wonder if he read your blog and reconsidered how absurd it sounded, because he made it sound he intends to go silent or hide information that most of us are already aware of, and the NCAA is already aware of.

Marc Johnson didn't encourage the perception in the powerpoint that he was going to comply with the NCAA's requests for information, and that he would withhold information or lie if he had to.

What did he possibly think he could hide from the NCAA or the general public at this juncture - since your website, letters, and the upcoming grand jury hearing and court transcripts have all been published on your web page and have left no details escaping the lenses?

Does Marc Johnson think that the power point presentation shows that as even an interim college president, he is ethical, inscrutable, on the ball. Is he even sound of mind?

UNR Administration Prepared To Lie To The Regents?

The Nevada Board of Regents has a two-day meeting scheduled in Las Vegas on December 1-2, 2011.

Item #15 on the agenda:

UNR President Marc Johnson presents for information the University of Nevada, Reno Intercollegiate Athletics practices and policies for compliance with the National Collegiate Athletic Association (NCAA) rules.

A link to UNR's planned powerpoint presentation is included in the agenda.

On November 21, 2011, the university administration was notified that, in so many words, it would be a really bad and dishonest idea to deliver this presentation to the Regents in its present form.

There are a few people, including the folks at the NCAA, who will be real interested if President Johnson presents this powerpoint as planned.

Serious Allegations Levied Against Attorney Kent Robison

As mentioned below, UNR's outside counsel Kent Robison has been sued twice in recent months.

The first case is filed under negligence and it alleges dishonesty and other improper conduct by Robison.

We reviewed the second case over the weekend. This complaint alleges, among other things, the following against Robison and his law firm:

        - Concealed gross negligence, malfeasance, and self-dealing

        - Malpractice

        - Egregious conduct

        - Common law negligence and lack of skill

        - Complete/total breach of ethical duty not to engage in self-dealing

        - Intentional harm, willful neglect, unethical conduct

        - Continuous course of fraud on Plaintiffs throughout the entire time
          Robison, et al represented them

Between the allegations in the two cases pending against Robison, combined with the evidence of his fraud and corrupt litigation practices on this site, there is a clear pattern here.

Here is hoping this fraud is permanently disbarred sooner than later.

By the way, we are hearing rumors that there may be a third case pending against him as well.

Lies, Cover-Ups, Perjury, Despicable Leadership

By now we have all seen the disturbing situation at Penn State University.

Due to the overwhelming media coverage, there is no need to recite the facts here. However, readers have asked that we address the Penn State situation and the parallels to the University of Nevada.

Lies, cover-ups, perjury, corruption in the university police department, failed leadership from the top down ... there are plenty of parallels between Penn State and Nevada.

The only thing missing at Penn State so far is a public accusation that its legal team is implicated in this mess.

At Nevada, General Counsel Mary Dugan is at the helm of the corruption. When Dugan's reign of corruption comes tumbling down, expect all fingers of her co-conspirators to point to her as the ringleader.

At Penn State, this despicable scandal has ended the careers of the President, Vice President (in charge of the police department), Athletic Director, Head Football Coach, and Assistant Football Coach . . . so far.

The Nevada contingent of Dugan, President Marc Johnson, Athletic Director Cary Groth, Police Chief Adam Garcia, and Garcia's boss, Vice President Ron Zurek, are certainly watching the Penn State story closely.

Cary Groth A Poster Child For Failure, Kent Robison Sued

Following up on Nevada A.D. Cary Groth's failed administration . . . both the soccer and volleyball teams failed to qualify for the conference tournament.

Soccer (3-16) finished in a tie for last place while volleyball (5-18) is in a battle for the same with three games to go.

What makes things more maddening is that Groth could care less and the student-athletes know it.

Speaking of corrupt liars, UNR's outside attorney Kent Robison has been sued twice in recent days.

One of the suits was filed against him in July. The other was filed on October 5th.

The October 5th suit is filed under negligence and it alleges dishonesty and other improper conduct by Robison.

Apparently we are not the only one who knows that Robison is unethical, dishonest, and corrupt to the core.

"Everyone Knows Who The Corrupt Players Are"

For those keeping score, Athletic Director Cary Groth and Nevada are a rousing 11-33 on the year. Football is 4-3 overall, Soccer 3-14, and Volleyball 4-16.

On another note, a number of readers have commented regarding the threats recently received (see posts below). Here is one such note from a reader:

Everyone on campus knows who the corrupt players are - from the administrative staff, the UNR Lawyers, and even the persons that did not earn their present positions through education, credentials, or merit.

Nothing dares happen to you, because we know EXACTLY who the persons of interest are and where they presently work. We are all watching your back!

If and when they get another job - which is highly unlikely due to the reputations they themselves have created - their next employer would have to keep very very close tabs on them.

If a parent googles the name of one of these new college hires (alias) criminals, then they are going to have to ask the question: "Why would this person leave UNR with such a horrible unethical criminal reputation only to be hired by this particular college or university?"

The big question is how serious it is, and the motivation of the party in question. This bothers me.

One thing to cheat in court, another to contemplate a Silkwood. This bothers me a lot, because there are some very sick people out there.

Word on the inside is that [interim President] Marc J. isn't going to make the short list for President.

Word too is that they've hired an outside headhunter to avoid legal requirements that would normally reveal who was applying for the position in order to mask the identities of resume submitters who don't want current employers to know they're thinking of bailing.

Another reason to keep things quiet is to thwart people like us from "helping" in the vetting process.

Catching Up With Readers And Commenters

Let me first say that I have followed the case very closely because I have worked for Cary Groth and found her to be the most unprofessional boss I've ever had.

I also worked with Cindy Fox and Andrea Pearson, two very unprofessional people. Ms. Pearson came to the Athletic Department as a former cocktail waitress. No high school degree (GED only) and no college degree.

As soon as Coach Ault left the AD position, Cindy Fox was determined to get Andrea Pearson from her current Receptionist position to that of the Assistant to whoever the new AD would be because Andrea was dishonest just like Ms. Fox is. Cindy Fox loves people that she feels she can control.

Then Cary Groth gets hired and they team up and run the current Assistant to the AD (who was very good by the way) to a lesser position so that they could get the dishonest Andrea Pearson in that position!

This kind of crap happened all the time under the direction of Cary Groth and Cindy Fox. Two very bad people in my opinion. Now with Cindy Fox gone, nothing has changed, and Andrea Pearson is still her dirty puppet.

I hope you get Groth and all the dirty birds out of there, sooner than later!!!

Meet Andrea Pearson . . . She Lies Too

Nevada Athletic Director Cary Groth, former Associate A.D. Cindy Fox, and the dirty UNR lawyers solicited weak-minded individuals to assist them in their corrupt activity.

Several of these individuals have been previously discussed. However, a few have escaped mention to date.

Meet Andrea Pearson, Assistant to the Athletics Director...she lies too. Ms. Pearson is/was the assistant to Groth and Fox (when Fox worked there).

Several months back, UNR produced an email communication from Ms. Pearson to a national organization governing soccer.

The obvious purpose of Pearson's email was to attempt to gather 'negative information'.

Guess what? Pearson blatantly and indisputably lied to this organization in her email.

Despite this, her efforts still failed. They did not have anything negative for her. As a matter of fact, they confirmed that Patraw had attained the highest standing in their organization.

Pearson likely has no idea that the lawyers produced these communications.

True to form, the UNR lawyers threw Pearson under the bus after she attempted to assist them in their dirty work . . . just as they did with Antoinette Marjanovic, Graeme Abel, Cindy Fox, and others.

Groth Says Soccer Program Is "In Much Disarray"

The Nevada Sagebrush called out the losing culture in Nevada Athletics under Athletic Director Cary Groth.

Kudos to the student paper for writing about Groth's failed leadership ... something the Reno Gazette Journal would never do ... until Groth is canned.

Afterall, the RGJ "has UNR's back".

The Sagebrush pointed out that "no team in Nevada athletics has a winning record".

After Nevada went 0-5 this past weekend, Groth/Nevada are 5-26 on the year. Football is 1-3, soccer is 2-11, and volleyball is 2-12.

Perhaps President Marc Johnson will spare us another "Nevada Athletics is healthy and successful" speech.

Groth's response to these embarrassing records:

“There comes a point when you have to start winning,” Groth said. “Winning is so important because it’s directly tied to donations, it’s directly tied to attendance and ticket sales.”

“You just have to watch how you’re progressing in your programs,” Groth said. “Soccer has been a program in much disarray for a few years...”

“But there comes a point ... when you have to start winning or changes will need to be made,” Groth said.

The changes need to begin with Groth's removal. And, when has she EVER cared about winning?

Groth's decisions pertaining to Head Coaches have consistently been to:

1) give contract extensions to chronically unsuccessful head coaches;
2) retain morally bankrupt head coaches;
3) promote assistant coaches of already unsuccessful programs;
4) promote assistant coaches that are nowhere near qualified to be Division I head coaches;

It is Groth's mis-management that has Nevada Athletics at an all-time low.

And, Groth's behavioral issues (compulsive lying, fabrication of documents, and retaliation) are the reason the soccer program is "in much disarray".

Ramifications Of Associating With A.D. Cary Groth

CBS Sports had a great story this week on the fallout from former Tennessee Head Basketball Coach Bruce Pearl's NCAA scandal. Pearl was let go after he was caught lying to the NCAA.

The story talks about the ramifications to Pearl's assistant coaches. The assistants were also charged with lying to and/or withholding information from the NCAA to protect their boss, Pearl's, misconduct.

It is interesting to read the assistant coaches comments and their feelings of betrayal by Pearl many months later. They no longer communicate with Pearl, and their careers and reputations have taken a serious hit.

The story was a reflection on what we are witnessing here.

How do you think Antoinette Marjanovic, Graeme Abel, Cindy Fox, Dedrique Taylor, and soon to be several others (i.e. Jean Perry, Tekla Martin, etc.) feel now about their decision to associate with Nevada Athletic Director Cary Groth to fabricate evidence?

Marjanovic, Abel, Taylor, and Fox have all had their careers negatively impacted due to their ill-fated associations with Groth. Fox and Marjanovic are out of the NCAA. Taylor missed out on a head coaching opportunity and Abel has shuffled from one losing program after another.

And we are willing to bet that none of them are on Groth's Christmas list.

I think that there is a strategy in place. While interim President Marc Johnson is a limp spine, lame duck, he is removing Cary Groth from her athletic department signing abilities.

He knows he is a lame duck, having many meetings with the university lawyers, probably got his salary upped for taking Milt Glick's position, was willing to be acting president for awhile, and collect his paycheck, while planning intricate strategies with the lawyers behind the scenes to move out Groth.

They don't trust her and don't want her, otherwise they would not take department signing responsibilities away from her.

It is also a message to Groth, if she is halfway bright, that she is slowly, very slowly, being moved out, so that when it does finally happen, it will not come as a shock to her, as it is not a shock to any of us.

Problem is, what kind of a person would want to be the UNR President if he or she read your website, if they did their own digging into the court records, if they actually knew what they were stepping into?

It would have to be someone that was totally in the dark, or someone that UNR was planning to take the helm all along, who is already being groomed and staged for the position. They may have that person in mind, but will seek resumes just to look good.

I repeat. Knowing the history of UNR, who would gleefully take the position of UNR president?

Removal Of Groth's Authority, Search For New President

A couple of tidbits:

UNR's response to the post directly below (re: revocation of A.D. Cary Groth's signature authority) has been . . . . . . . . . . silence.

That is right ... nobody and we mean nobody is denying it. Not the university lawyers, not Cary Groth, not Bruce Shively, not the interim-President.

Keep in mind that these folks all read this blog and that Groth and the central administration are aware that this information is out there.

On another note, the Regents announced that they are beginning a search for a President at UNR.

This does not bode well for interim-President Marc Johnson considering that UNLV recently promoted their interim-President to President without conducting a search.

Since Johnson has retained Groth despite his obvious knowledge of her incompetencies and corrupt leadership, we will not be sorry to see him leave.

Has A.D. Cary Groth's Signature Authority Been Revoked?

A whole lot of people are saying the same thing ... nobody is denying it ... and, UNR appears to confirm...

That Athletic Director Cary Groth has had her signature authority on financial matters in Nevada Athletics revoked by the President.

This unbelievable information has been passed on to us by multiple sources over the past several weeks.

Bruce Shively, Associate Vice President of Planning, Budget, and Analysis, was confronted about this "rumor" and did not deny it.

Sure enough, UNR updated its "Signature Authority List" on August 3, 2011. Lo and behold, the athletics department reads as follows:

                    ATHLETICS (ICA)
                Marc Johnson, President
                Cary Groth GIA/LOA/EVAL

Notably, Athletics is the only department on campus (other than the President's Office) that has the President listed as the signature authority.

Additionally, Groth is the only department head with limitations listed.

The abbreviations next to Groth's name stand for: Grant-In-Aid (athletic scholarships), Letter of Appointment (temporary hires), and Evaluations (personnel evaluations).

So, according to this public document, Groth is only allowed to sign on scholarship offers, temporary hires, and personnel evaluations!

A critical aspect of a Division I Athletic Director's job is to manage the budget. Yet, Groth has had her authority revoked on Athletics finances?

What exactly is Groth's job if she is not trusted with oversight of financial matters in the department?

Managing winning programs is not part of her job description.

For those keeping score, Nevada's fall sports (volleyball, soccer, and football) had another very-Cary Groth-like weekend ... going a combined 1-4.

Oversight of NCAA compliance is not part of her job duties.

So President Johnson, how is this fraud still employed in your administration?

Cindy Fox Wearing Out Her Welcome In Georgia?

It appears that former Nevada Associate AD Cindy Fox is showing her true colors and quickly wearing out her welcome back east:

My wife volunteers with the American Cancer Society and was APPALLED by how badly Cindy Fox treated the volunteers at the Suits and Sneakers event she ostensibly puts on in Athens, Georgia.

She is fake, she is abominable and she is horrendous.

It is VERY easy to believe your blog. She is a manipulative, self serving mean person.

This comment was posted on the blog, "Associate AD Cindy Fox Covered Up NCAA Violations".

That blog detailed Fox's cover-up of violations in her husband's (Mark Fox) basketball program, as well as her fabrication of personnel files.

Fox's character and integrity, or lack thereof, are being exposed across the country.  The positive? She is no longer involved in intercollegiate athletics.

A.D. Cary Groth's Failed Management Of Nevada Athletics

Three weeks into the NCAA's fall sport season and the numbers continue to expose Athletic Director Cary Groth's failed management of Nevada Athletics.

The Nevada soccer team went 0-2 on the weekend, while the Nevada volleyball team went 1-3.

This leaves the soccer team with a 1-5 overall record, and the volleyball team sporting a 1-6 mark.

The football team, of course, was sitting at home with a bye as they prepare to deal with Groth's unbelievable scheduling debacle.

So for those keeping score, Groth is a combined 2-11 on the year.

Groth is probably considering handing out raises and contract extensions to the soccer and volleyball coach as the very insecure A.D. likes to surround herself with people less successful than herself.

President Marc Johnson, your athletic department is extremely unhealthy.

It is time to remove your corrupt, financially incompetent, and indisputably unsuccessful A.D. The grossly mismanaged athletic department is now a reflection of you.

Welcome To Cary Groth's Department Of Intramurals

Over two weeks late, and certainly in response to thr blog directly below, Nevada A.D. Cary Groth announced that she has named an interim tennis coach after the head coach recently resigned.

Psst...Groth has admitted to being a regular reader of this blog (she said she doesn't like it).

According to the announcement on the Nevada athletic department website, "Nevada will conduct a national search to fill the [tennis] position on a permanent basis this spring".

You may recall a post last February, "More Incompetence By A.D. Cary Groth". There we discussed Groth's decision to name an interim volleyball coach and conduct a national search for a new coach after the next season (10 months later).

Groth named an assistant coach the interim volleyball coach so she would not have to pay a head coach's salary until the "reassigned" head coach's salary came off the books on July 1, 2011.

Groth then elevated the interim volleyball coach to head coach on July 22, 2011. See how that works. The "reassigned" head coach then left the university this summer. Tidy, huh?

Damaging to recruiting? You betcha! Difficult on the student-athletes and program? Absolutely.

Groth is avoiding paying a head coach's salary again, announcing an interim tennis coach for the entire upcoming academic year. Student-athletes and recruits be damned!

Groth continues to demonstrate that she will sacrifice the athletes and the success of the programs due to her inability to manage a budget and raise money at the level necessary to lead a Division I athletic program.

Nevada Tennis Coach Escapes Groth's Corrupt Leadership

The Head Women's Tennis Coach resigned from Nevada to accept the same position at San Jose State. Curiously Nevada did not announce this on their website nor did they release it to the media. Why?

One would venture a guess that Nevada Athletic Director Cary Groth does not want to let the community know that a coach is essentially accepting a demotion to escape her gross mismanagement (i.e. corruption).

While San Jose State is currently in the same conference as Nevada, this move appears to be a step backward for a couple of reasons:

1) Nevada is currently a much more successful tennis program than San Jose State; and 2) Nevada is moving into the substantially better Mountain West Conference next season while San Jose State is remaining in what will be a dramatically weakened Western Athletic Conference.

For the record, this coach would not shy away from competition. He came to Nevada from the ACC and did a good job elevating Nevada's program.

Who does Nevada hire to replace him? Well, Groth's long-time domestic partner, Laura Scott, was the Head Tennis Coach at Northern Illinois University under Groth.

Scott is currently working as an academic advisor in Groth's athletic department at Nevada. We discussed this previously in "Corrupt Hiring Practices in Nevada Athletics?"

Will President Johnson let Groth hire Scott wants back into coaching?

Johnson knows Groth's tenure is coming to an end. If he is smart he does not let her have any say in who the next tennis coach is.

Withholding Donations Until Groth Is Terminated

A few notes heading into the weekend:

- A group of loyal donors to the University of Nevada athletic department have made a collective decision to withhold donations until Athletic Director Cary Groth is terminated.

- The highly publicized NCAA scandal at the University of Miami is no suprise. Miami's former athletic director, Paul Dee, is hardly the epitome of integrity. Much deserved karma is coming back to haunt Mr. Dee.

- To the reader identified as "Scottsdale", your message was received and passed along to the appropriate individuals. They will be in touch.

- Former assistant soccer coach, Antoinette Marjanovic, was let go from her Nevada coaching position and fled the state in 2008. We were just informed that she is also no longer employed at Kansas University.

For the sake of student-athletes let us hope she is never employed at another NCAA institution again. Marjanovic was implicated by student-athletes in soliciting them to fabricate evidence.

Email communications and phone records indisputably prove Marjanovic and her co-conspirator Cindy Fox engaged in this despicable, not to mention criminal, behavior.

Fortunately the student-athletes had more maturity and integrity than Marjanovic and Fox.

Follow The Leader - Boise State Athletics

Boise State dismissed its athletic director, Gene Bleymaier, last week in the wake of an NCAA investigation.

President Bob Kustra stated, "... I determined that new leadership will be needed as we commit ourselves to the highest level of attention and enforcement of NCAA standards, and also continue to move Boise State athletics to the next level of success."

"... his decision is predicated on the confidence level he believes he needs to have as president in the university's compliance operations during an NCAA probationary period," Bleymaier said.

Nevada President Marc Johnson needs to take a page or two from its highly successful peer institution.

Nevada is in the midst of its own NCAA probationary period and is in an especially dangerous position in light of the newly reported NCAA and criminal violations of Athletic Director Cary Groth.

President Johnson, the NCAA, the Mountain West Conference, and the WAC are informed. Will Johnson jeopardize the future of Nevada athletics or will he act like a leader with ethical standards?

The Learfield Sports Directors’ Cup, the annual score card for overall on-field success of Division I athletics programs, released the 2010-2011 standings.

The numbers do not lie. Nevada is on a downward spiral of epic proportions under Cary Groth.

Out of 279 Division I programs, the Wolf Pack finished an embarrassing 190. How did Nevada's peer institutions do this year?

The proof is in the pudding. Groth has failed. Any employee with this performance record would be terminated. All but two current head coaches (baseball and football) have been hired by Groth.

Add in Groth's corruption, the NCAA probation, her fundraising deficiencies, the football scheduling debacle, and the $1.5 million budget deficit (she has led the department to budget deficits 5 out of 7 years).

It is long over due for President Johnson to act in the best interest of the university, tax payers, student athletes, and donors.

The latter three universities removed their athletic directors amid NCAA scandals, even though these A.D.'s were not implicated in any violations.

Mountain West Conference Commissioner Craig Thompson (Nevada's new conference in 2012) expressed his thoughts on NCAA misconduct:

Nevada Athletics Mocking NCAA Enforcement Staff

Last week at a very public hearing UNR lawyers (Mary Dugan, Joe Ward, and Kent Robison) disparaged the NCAA enforcement staff and their efforts to ensure integrity in intercollegiate athletics.

After a roughly 90 minute presentation of Cary Groth's, Cindy Fox's, and Jean Perry's NCAA misconduct (i.e. lying to the NCAA, fabricating NCAA reports, perjured testimony, direct admissions of retaliation, etc.), the lawyers responded, "So what?"

How 'bout that institutional control Marc Johnson? Certainly Mary Dugan informed you of her team's embarrassing behavior last week, right?

This scene was both video taped and transcribed by a court reporter.

When notified near the end of the hearing that this transcript and supporting video was going to be made available to the NCAA, the lawyers sat speechless and then huddled for long stretches in the hallway.

One can only imagine the documents and lies they are manufacturing to cover up their cover up of the last cover up; which was a cover up of the previous cover up.

Note to Fox and Perry...Groth admitted that she manufactured false NCAA records in coordination with you two. What are friends for, right?

Two more people that Groth used and then threw under the proverbial bus after they engaged in criminal activity to help her cover up NCAA violations.

A.D. Cary Groth, General Counsel Dugan Are On The Run

Nevada A.D. Cary Groth and General Counsel Mary Dugan are on the run.

Groth was in Kansas City last week for a "meeting". Groth is attempting to secure a future outside of Reno.

Unfortunately for Groth, however, her criminal activity as Nevada's Athletic Director is nationally known, especially in the intercollegiate athletics world (including certain search firms and the NCAA).

Dugan is also trying to run from her corruption at UNR.

According to sources, Dugan recently sought out a new position, hoping to dump all the problems she created at the university on someone else.

Unfortunately for Dugan, however, the potential employer became aware of Dugan's corrupt activity as UNR General Counsel and turned her down.

And, in case you haven't caught up on another blog, UNR Police Chief Adam Garcia is on the run too! Garcia has been applying for jobs all over the nation over the past few years.

However, his history of corruption has caught up with him too.

And, as we already know, the fourth member of the team, Milton Glick, has already left the room.

Kent Robison Admits A.D. Cary Groth Committed Perjury

If you haven't noticed by now, Nevada Athletic Director Cary Groth lies ... a lot. Her behavior clearly satisfies the definition of a pathological liar.

Sadly, this is not an exaggeration.

Interestingly, Kent Robison, who is a liar in his own right, recently admitted that Groth committed perjury:

Question: Had the 2.5-year [contract] offer been extend to [Terri]?

Groth: No

Kent Robison: “NSHE...offered her another appointment for 2.5 years with a raise, which Patraw rejected.”

To be clear, this is not a he-said, she-said deal.

UNR's General Counsel, Vice President of Human Resources, Associate Athletic Director, and Provost, as well as another university's Athletic Director, all testified that the contradt was offered.

Looks like Groth is running out of partners in crime, and the rats are fleeing her sinking ship . . .

I would wager a hefty sum of money that Tekla Martin and Cary Groth have been asked to leave politely, months ago, just like Police Chief Adam Garcia.

They are asked to look for employment elsewhere, in the hopes that UNR can write a syrupy PR article about them moving on to green pastures, without the appearance that they were pressured to leave in any way.

Problem is, after googling their names, what reputable university or place of employment would want them?

The PR article specifically designed and written for the Reno Gazette Journal must be written to sound like both were excellent employees, and the decision to move on was solely their own.

Meanwhile, President Marc Johnson says a prayer and crosses his fingers, that some college or university will actually want them, and take the problem off his hands.

I had no idea Charles Hilsabeck left the legal profession. He didn't like looking at himself and the others he was surrounded with, in the lenses and mirrors.

The "Guilty Dogs" Are Leaving The University

In a conversation with a friend the other day and we were talking about the "guilty dogs" at the University of Nevada who "left the room" after their criminal activity was exposed:

Milton Glick - He passed away in April 2011.

Cindy Fox - She fled to another state and left intercollegiate athletics altogether.

Antoinette Marjanovic - She was let go from her Nevada coaching position and fled the state.

Graeme Abel - He fled the state and then Nevada refused to re-hire him 2 years later.

Chuck Hilsabeck - He left the university and quit the legal profession.

So for those keeping score, that is 5 "guilty dogs" who are no longer at the university, with 4 more to go to clean up the corruption in Nevada Athletics.

The four remaining guilty dogs?

Cary Groth, Jean Perry, Tekla Martin, and Mary Dugan

Everybody knows that Groth is on her last days as Athletic Director.

Martin will be sent packing by any self-respecting new Athletic Director.

As for Perry and Dugan, karma is coming back to haunt them and something tells us they are feeling it daily.

Cleaning Up Glick's Sorry, Messy, Unethical Legacy

Johnson and Glick would have had to discuss the university problems frequently.

This means that Johnson has to have a clear understanding of the kinds of persons he is surrounded by.

He has to know what a manipulative, dishonest human being Glick was, along with Mary Dugan, and the rest.

President Johnson has the choice of being honest, and cleaning up Milton Glick's sorry, messy, unethical, legacy or he must accept and take responsibility for what he doesn't.

New University President Marc Johnson reads this blog too!

President Johnson is picking up where the late Milton Glick left off.

What this means, of course, is that Johnson cannot deny knowing that his Athletic Director, Cary Groth, lies, covers up NCAA violations, fabricates evidence, and retaliates against those who report violations.

This also means that if Johnson retains Groth he is willfully subjecting Nevada to severe NCAA sanctions.

And, of course, if Johnson retains Groth it means that Johnson is willing to go down with Groth's sinking ship.

Speaking of sinking ships, the Reno Gazette Journal posted a blog a week or so ago that revealed that Groth has run 6 to 7 figure budget deficits in the athletic department in 5 of her 7 years as Nevada's A.D.!

That puts a big kibosh on UNR's spin trying to blame the economy.

To make matters worse, the numbers are getting larger...much larger...not smaller, reaching an astonishing $1.5 million this year (nearly double last year's $800,000).

It is past time to blame Groth and her buddy Tekla Martin, who oversees development.

Now that we know Johnson reads this blog, what is he going to do about Tekla Martin misrepresenting her academic credentials on the athletic department website?

Kockenmeister Implicated In Bribery Scandal

Nevada Hearing Officer Kockenmeister has been implicated in bribing a former state employee in an effort to conceal his misconduct on the job.

Hearing Officers administer hearings that afford state employees the opportunity to seek reinstatement to their positions.

The evidence of this alleged bribe has been forwarded to authorities. It was also brought to the attention of the Personnel Commission last week.

Kockenmeister is the same corrupt Hearing Officer Patraw had in her reinstatement case.

That result was later invalidated after proof of perjury, fabrication of evidence, and concealment of documents (by Nevada's corrupt Athletic Director Cary Groth) was brought forward on appeal.

There was also indisputable proof that Groth, Kockenmeister, and UNR attorney Charles Hilsabeck conspired to fabricate evidence in that case.

Kockenmeister was subsequently suspended for 3 months.

Here is hoping the latest evidence of his misconduct ends his tenure as a Hearing Officer for good.

Nevada A.D. Cary Groth Is Jeopardizing Nevada's Future

The North Carolina Tarheels received a notice of allegations from the NCAA.

The NCAA accused UNC of a number of major violations in the football program, including unethical conduct by a former assistant coach.

The former assistant coach, John Blake, is charged with providing "false and misleading information" to the NCAA investigators.

Question: What do John Blake, Bruce Pearl, and Jim Tressel all have in common (in addition to the fact that they have all been charged with lying to the NCAA)?

Answer: The all have the label "former" attached to their names!

All three of the NCAA's alleged liars were forced out of their positions at their respective universities (UNC, Tennessee, and Ohio State) by their institutions leadership.

At Nevada however, the late Milton Glick buried his head in the sand despite full knowledge that A.D. Cary Groth lied to the NCAA and covered up major violations of NCAA rules in the basketball program.

The question now looms for interim-President Johnson, who is fully informed of Groth's unethical conduct and lack of institutional control:

Will President Johnson remove his "lying, scheming, sportsmanship abusing" Athletic Director?

Or will he continue to risk the future of intercollegiate athletics at the University of Nevada, and his potential future as UNR President?

Eyes throughout the NCAA are watching and waiting . . .

Is Nevada A.D. Cary Groth Being Forced Out?

In the RGJ last week, Nevada Athletic Director Cary Groth shot down rumors that she was resigning.

According to the article there is dissension between Groth and board members on the Athletic Association of the University of Nevada (AAUN), with some perhaps trying to force her out.

Groth seemed to confirm as much with this statement:

"But when it gets unhealthy, that’s when you don’t need those board members around."

Not the smartest move for an athletic director to take shots at some of the most dedicated donors to Nevada Athletics. But then again, we have never heard anybody accuse Groth of being smart.

When asked whether she expected to finish her contract which runs through June 2013, Groth told the RGJ that she has “no reason to think otherwise.”

C'mon, Cary tell the community the truth...for once!

It hasn't escaped the attention of those following this story that not a single university official has backed up Groth on this "I am not resigning" story.

Which proves interim-President Johnson is smarter than the late-Milton Glick.

If nothing else, we now know that when Groth does leave in the near future, it will not be by her own choice.

And, by the way, didn't Rep. Anthony Weiner recently tell us he was not resigning from Congress? Yet, days later he...well...resigned.

We also heard the same "I am not resigning" story from Ohio State football coach Jim Tressel and Tennessee basketball coach Bruce Pearl. And, shortly thereafter they both left under pressure.

This note from a reader says it all . . .

If you were managing a company whose mission was to be profitable, wouldn't you be looking at the ROI of your whole company, and efficiency?

In times of tight budgets, wouldn't you be positioning your management to be flexible as conditions become more volatile?

Isn't that [Nevada Athletic Director] Cary Groth's job?

Isn't her responsibility to give equal opportunity, and support, to each and every coach to insure that the "college experience" the university proudly pledges to support is in fact realized?

What we see in practice though is Groth dismissing a coach who is a solid winner, and replacing that coach with someone who fails to maintain the performance of the one dismissed.

We see coaches retaining their jobs after being charged with transgressions athletes would be bounced off the team for.

We continue to see NCAA violations, and even UNR's President Johnson says there continues to be "little" NCAA violations.

As if little or small is somehow acceptable? WHEN YOU'RE ALREADY ON PROBATION??

Groth isn't running the Athletic Department well from an athletic perspective, nor is she being fiscally responsible from a financial one.

Groth is hanging by a thread. Everyone can see it, UNR won't admit it.
